The purchase of pots and utensils (hereinafter the “Products”) for sale on the cuartigiana.it website (hereinafter the “Site”) is consequential to the stipulation of a sales contract between the user of the site (hereinafter the “User”) and CU ARTIGIANA DI MERONE PASQUALE Via Romani 134 80048 Sant’Anastasia VAT number: 00688901214. The sales contract is concluded on the “on-line” Site, that is, it is a distance contract, or the legal transaction concerning movable property stipulated between the Company and the User in the context of a remote sales system organized by the Company which, for this contract, uses the remote communication technology called “internet”. The purchase agreement is concluded with the acceptance by the Company of the order placed by the User on the Site. The User’s order, being subject to the availability of the requested Product models, as well as to the place of delivery and to other factors, constitutes the proposal that may be accepted or rejected by the Company at its sole discretion. The acceptance of the Company takes place through the order confirmation that is sent to the email address indicated by the User following receipt of the order (hereinafter the “Order Confirmation”). In case of non-receipt by the user of the Order Confirmation, the same will be deemed rejected by the Company. Obviously without prejudice to the possibility of an express refusal sent by any means (therefore also using ordinary e-mail) by the Company.

By sending the purchase order through the Site, the User declares to have read these conditions of sale (hereinafter the “Conditions of Sale”) and the payment conditions (hereinafter “Payment Conditions”) and to accept them integrally.

If the User is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the sale has been concluded he will have to keep (by printing or saving an electronic copy) these Conditions of Sale and the Terms of Payment as the same will remain applicable to your purchase even if subsequently modified by the Company.

In fact, these Conditions of Sale, together with the Terms of Payment and the Privacy Policy, may be updated or modified at any time by the Company which will communicate it according to times and methods that will be defined unilaterally by the same at its sole discretion.

The price of the Products, already indicated on the site, will be confirmed in the Order Confirmation separately for each of the Products ordered. The Company reserves the right to confirm or change the prices of Products not available in stock at the time of the Order Confirmation based on the current price lists if they are different from those of the order date. The Order Confirmation will contain the image and model of the Products ordered, the order number, the date and time of the order and the User data. In case of temporary unavailability of the ordered Products, the User will be promptly notified and will have the right to choose whether to complete the purchase or to renounce it. The User undertakes to promptly notify the Company of any corrections to be made to his data. The data included in the Order Confirmation will be necessary for the delivery of the Products and to identify all communications between the User and the Company.

The image accompanying the Products may not be fully representative of their characteristics and may differ in color and size.

Information about shipping

Shipping to Italy

The Products are shipped free of charge to the User by express courier. The User is required at the time of collection of the Products to check, in the presence of the carrier, the integrity of the same. In case of receipt of damaged Products, delivery must be refused immediately.

Following the Order Confirmation, the User will receive a shipping confirmation within 24/48 hours from the same (hereinafter “Shipping Confirmation”). The Shipping Confirmation will contain both the data contained in the Order Confirmation and a number that will allow the traceability of the Products from the Company / place of shipment to the address indicated by the User for receiving them. The Products are delivered throughout Italy within 24/48 hours of sending the Shipping Confirmation, with the exception of the Minor Islands where the products are delivered within 72 hours of the Shipping Confirmation. The aforementioned times for sending the Shipping Confirmation and for the delivery of the Products are merely indicative and may vary both for reasons relating to the availability of stock of the Products and for reasons entirely independent of the Company and attributable to the shipper.

The User can always check the status of his orders from the Site under “Order status and monitoring”.

International shipments

The Products are shipped by express courier. For some European countries, shipping is free, for others, the cost of shipping will be added to the price of the Products, which may vary depending on the country. The User is required at the time of collection of the Products to check, in the presence of the carrier, the integrity of the same. The aforementioned times for sending the Shipping Confirmation and for the delivery of the Products are merely indicative and may vary both for reasons relating to the availability of stock of the Products and for reasons entirely independent of the Company and attributable to the shipper.

The User and / or the person in charge of the same to collect the Products is required to check, at the time of delivery and in the presence of the carrier, the integrity of the packages delivered and the relative number, reporting any discrepancies in the number and / or integrity of the packages in writing in the appropriate space reserved in the transport document (DDT) which, duly signed, will remain with the carrier. Once this is done, the User must contact the courier’s Customer Service to report the problem.

Terms of payment

For each of the Products on the Site, the price requested by the Company for the purchase is easily identifiable. All prices indicated for the Products, both on the Site and in the Order Confirmation, include VAT. This tax is applied for purchases with delivery on the Italian territory and in European Community countries. For non-EEC countries this tax will not be applied. In the latter case, the Company is not liable for customs and import duties, or customs clearance costs that may be applied to the Products by the competent local authorities.

The following payment methods are available for all orders sent by the User on the Site:

– Cash on delivery (only for Products to be delivered in Italy and with a supplement of Euro 3.50 compared to the price of the Products) *.

* Payment by cash on delivery provides the possibility for the User to pay the price of the Products in cash directly to the carrier upon delivery. In this case, payment, again to the carrier, of an additional price, to be added to that of the Products, equal to Euro 3.50 (six) for the service received. Under no circumstances will the courier accept checks, bank checks, circulars, or any other form of payment.

In the event that the User has decided to proceed with the purchase by paying with cash on delivery, the Order Confirmation will indicate both the price of the Products (distinguishing the price of each Product in the case of multiple purchases) and the additional price for the mark.

 

Payment security

Transactions made on the Company’s Site are completely secure. The Company relies on PayPal and Stripe, the most famous and used payment tools worldwide. Paypal allows the User who holds a credit card to provide their sensitive data (card number, expiry date, name, etc.) directly to the Bank and not to the Company or the service provider that manages the Site. In fact, when the User decides to pay by credit card, the payment page resident on a secure server is called up (the 128-bit public / private key encryption system is used, as a total guarantee for the buyer), in which they are requested sensitive credit card data. The Bank is responsible for conveying this data in international circuits and returning the outcome of the transaction to the customer. At the end of the purchase procedure, an e-mail notifies the outcome of the transaction. The security of these systems is guaranteed by an SSL3 encrypted transport protocol with a 128-bit symmetric key (currently the highest security standard with server-side certification). This encryption system makes sure that information cannot be read or captured by malicious people.

 

Right of withdrawal

Pursuant to the Consumer Code (Legislative Decree 206 of 6 September 2005), if the User is a final consumer (ie a natural person who purchases the goods for purposes not related to his professional activity), or if he does not carry out the ‘purchase by indicating a VAT number in the order form, you have the right to withdraw from the Purchase Agreement for any reason, without the need to provide explanations within 14 (fourteen) days of delivery of the Products. In order for the exercise of the right of withdrawal to be valid, the User must send a specific communication to this effect to the Company by registered letter to the address of the operational headquarters in VIA ROMANI 133 80048 – SANT ANASTASIA (NA). This communication, which must unequivocally contain the express exercise of the right of withdrawal and the references and data contained in the Order Confirmation, must be sent no later than the essential deadline of 14 (fourteen) days from the delivery of the Products. Following the communication to exercise the right of withdrawal, the User must return the Products to the Company. The Company will appoint the same shipper who carried out the delivery for collection, with an additional cost to be paid by the User equal to Euro 12 (twelve). If the User prefers it, subject to the express choice made in this sense simultaneously with the exercise of the right of withdrawal, the User may directly return the Products to the Company, taking into account that the Products must be returned no later than 14 (fourteen ) days from delivery. In this case, the Products to be returned will be sent to the operational headquarters in VIA ROMANI 133 80048 – SANT ANASTASIA (NA). Following the exercise of the right of withdrawal and the return of the Products, the Company will refund the price paid by the User for the Products, by bank transfer to the coordinates that will be indicated by the User.

In the event that the User has received the Product abroad (see paragraph on International Shipping), the User himself will have to provide at his own expense for the return of the goods by courier or by any other means that allows the traceability of the shipment. . Following this shipment, the User must communicate the relative traceability code to the Company.

 

Product Return

Within the essential period of 14 (fourteen) days from the delivery of the Products, the User may communicate to the Company, also by telephone or ordinary e-mail, the intention to make an exchange.

Once the User has communicated the intention to make the change, the Company will appoint the same shipper who made the delivery for the collection, with an additional cost to be paid by the User equal to Euro 12 (twelve).

In the event that the User has received the Product abroad (see paragraph on International Shipping), it will be the User himself who must provide at his own expense to return the goods to be changed, by courier or by any other means that allows the traceability of the shipment. Following this shipment, the User must communicate the relative traceability code to the Company.

 

Refunds

Refunds will only be made following receipt of the Products by the Company.

Defects and non-conformities

The User must always, upon receipt of the Products, check the goods received and, if he finds anomalies and / or defects, he must refuse delivery. If the anomaly and / or defect is found, the Company will exchange the Product at no additional cost for the User.

In the event that the User, upon receipt of the Products, finds damage to the package, the packaging or the Products that are evidently or even potentially due to transport, in addition to refusing the delivery of the product that is not intact, he must give immediately notify the Company. In case of damage, the Company will exchange the Product at no additional cost for the User.

The Products are covered by the legal guarantee provided by law. If the User finds a lack of conformity of the Products after delivery, the User must report the same to the Company in compliance with the terms and conditions for withdrawal. Where the same occurs, it will exchange the Products at no additional cost for the User.

How to cancel the order

To cancel an order, simply send, before 10:00 a.m. (Italian time) on the day following receipt of the Order Confirmation, an e-mail to cuartigiana@libero.it indicating the progressive number of the order issued at the time of purchase. In this case, the order will not be shipped and any amount already paid, excluding the costs incurred for collection, will be immediately reimbursed to the bank details you will indicate to us. After 24 hours from receipt of the cancellation request, the contract with the Company will be considered terminated.

Privacy

In order to complete the purchase, the User must provide some personal data. The User must read the Privacy Policy even if he does not intend to grant consent for advertising purposes.
